According to the Seyfarth Shaw LLP blog, “The total number of lawsuits filed in federal courts alleging that plaintiffs with a disability could not use websites because they were not designed to be accessible and/or work with assistive technologies in 2021 was 2,895–372 more than 2020.” This number seem relatively low but what it doesn’t count are the demand letters that never went to court. Over 150,000 demand letters have been served since 2017. 93% of demand letters settle outside of court for $20,000-$150,000 on average. The busiest courts to date are the ones in Florida, California and New York!
What’s a demand letter? “A demand letter is a letter, usually written by an attorney on a client’s behalf, demanding that the recipient of the letter take or cease a certain action,” according to the Legal Information Institute of the Cornell Law website. A demand letter might come to you stating your site is noncompliant and asking you for financial compensation on behalf of their client.
